Understand New York laws and regulations for nursing homes

Nursing homes in New York State are required to be licensed in order to legally operate. The New York State Department of Health (NYSDOH) licenses and regulates nursing homes in the state. They are referred to as skilled nursing facilities (SNFs) and must comply with state and federal regulations to maintain their license.

In addition to state regulations, the federal government also regulates nursing homes. The Centers for Medicare & Medicaid Services (CMS) is responsible for certifying nursing homes that participate in Medicare and Medicaid programs. Nursing homes that do not meet federal standards may be subject to fines, legal action, or even closure.

Assisted Living/Memory Care facilities are also regulated in New York State. Long-term care facilities for seniors must have an Assisted Living Resident License issued by the New York State Department of Health. In New York, memory care facilities also must have a Special Needs Assisted Living Residence designation, which has specific guidelines for memory care.

Inspections

In New York State, nursing homes are licensed and inspected by the Department of Health’s Division of Quality and Surveillance for Nursing Homes and ICFs/MR. Regular inspections, also known as surveys, are performed to ensure that nursing homes are complying with state and federal regulations. These surveys cover areas such as quality of care, staffing, infection control, resident rights, and more. They are conducted by trained survey teams, which may include registered nurses, licensed practical nurses, dietitians, social workers, and others.

Inspection reports and licenses for nursing homes in New York State can be found on the Health Facility and Provider Data website. This website provides a searchable database of all licensed healthcare facilities in the state, including nursing homes. To access inspection reports, select “Search for a Facility or Provider” on the website’s homepage, then choose “Nursing Home Profile.” From there, you can search for a specific nursing home by name or location and view its license and inspection reports. Inspection reports can be requested here. Medicare.gov also has inspection reports for consumers.

Nursing home standards

Nursing homes in Rochester are required to provide 3.5 hours of care per resident daily on average. In those hours, at least 2.2 hours of care must be provided by a certified nurse aide and at least 1.1 hours must be provided by a registered nurse or practical nurse.

To ensure proper care, nursing homes must assess each resident within the first 14 days of their stay and then update the plan every three months.

New York state law requires nursing homes to meeting residents’ needs, including:

COVID-19 regulations for Rochester nursing homes

As of February 2023, the COVID-19 regulations for nursing homes in Rochester, New York, are governed by state and federal laws and guidelines, including those set forth by the Centers for Disease Control and Prevention (CDC).

Vaccinations. One important regulation for nursing homes is the requirement to facilitate COVID-19 vaccinations for all residents. New residents and those readmitted to a facility must have an opportunity to receive the first or any required next dose of the COVID-19 vaccine within 14 days of admission.

Masking. Nursing home staff are also required to wear masks, practice good hand hygiene, and follow strict cleaning and disinfection protocols to minimize the spread of the virus within the facility.

Social distancing. Nursing home staff are required to maintain appropriate social distancing with residents and other staff members.

Quarantining. Staff members who test positive for COVID-19 should be quarantined and not allowed to return to work until they have met the established criteria for recovery.

CDC guidelines. The CDC has also issued guidelines for nursing homes to safely expand visitation options during the COVID-19 pandemic public health emergency (PHE). These guidelines include screening visitors for COVID-19 symptoms, requiring masks and other protective equipment, and maintaining social distancing measures during visits.
